Sealing or Expunging

Individuals with criminal records may be eligible to have their record sealed or expunged under Florida Law.  To determine if you are eligible to have your case sealed or expunged, review Florida Statutes 943.0585 and 943.059.  Additional information may be obtained from the Florida Department of Law Enforcement website at www.fdle.state.fl.us.

In order to have a criminal history record sealed or expunged, you must first obtain a Certificate of Eligibility from the Florida Department of Law Enforcement.  After a Certificate of Eligibility is obtained, you can then petition the court for an order to seal or expunge your record.   Forms for petitioning the court to seal or expunge a criminal history record may be obtained on our Forms page.

Individuals who apply to have a criminal history record sealed or expunged are responsible to pay a court cost of $42.00 as well as a certified copy cost of $27.50 to $37.50, depending on the number of copies required.
